Agreement to These Terms
These Terms of Use (“Terms”) govern your access to and use of the Ostria mobile application and related services (collectively, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
Eligibility
The Service is intended for users aged 17 and older. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
The Service
Ostria helps knitting enthusiasts manage materials and projects, including capturing yarn details, organizing collections, automatic color matching, recording knitting densities, row counting, and voice notes.
Some features may allow you to upload content (such as photos or text) for automated or AI-assisted processing. Uploading is optional and under your control.
Account Registration
- You may need an account to access certain features.
- You agree to provide accurate information (name, username, email) and keep it updated.
- You are responsible for maintaining account confidentiality and activities under your account.
Your Content
“User Content” includes content you submit or make available through the Service, such as text, photos, project notes, and support messages.
You grant Ostria a limited, non-exclusive, worldwide license to host, store, process, transmit, and display User Content solely as necessary to provide and improve the Service for you, including processing you request (e.g., generating results based on a photo you choose to upload).
Your responsibility: You are responsible for your User Content and represent that you have the rights to submit it and that it does not violate law or third-party rights.
Acceptable Use
- Use the Service for illegal, harmful, or abusive purposes.
- Attempt to gain unauthorized access to the Service or related systems.
- Interfere with the integrity or performance of the Service.
- Reverse engineer, decompile, or attempt to extract source code except where permitted by law.
- Upload content you do not have the right to use.
Privacy
Our Privacy Policy describes how we collect and use information. If you choose to upload images/text for processing, you control that choice, and Ostria handles such data as described in the Privacy Policy.
Intellectual Property
The Service, including its software, design, trademarks, and content provided by Ostria, is owned by Ostria or its licensors and is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Service.
Updates, Modifications, and Availability
We may modify, suspend, or discontinue parts of the Service at any time. We may also update these Terms. If changes are material, we will provide reasonable notice. Continued use of the Service after changes become effective means you accept the updated Terms.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OSTRIA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Automated and AI-assisted features may produce inaccurate, incomplete, or unexpected results. You are responsible for verifying outputs before relying on them.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OSTRIA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OSTRIA'S TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE AMOUNT YOU PAID TO OSTRIA FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR, IF YOU PAID NOTHING, US$10).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold harmless Ostria Team from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms.
Disputes, Governing Law, and Arbitration
- Governing law: governed by the laws of the jurisdiction where Ostria Team has its principal place of business, excluding conflict-of-law rules, unless applicable law requires otherwise.
- Informal resolution: contact us at mpwmqmzfdg2538@outlook.com before filing a claim.
- Binding arbitration: unresolved disputes will be resolved through binding arbitration, except where prohibited by applicable law, and on an individual basis (no class actions). Either party may seek injunctive or equitable relief for IP-related issues.
Apple App Store Terms (iOS)
If you downloaded the app from Apple’s App Store:
- These Terms are between you and Ostria Team, not Apple.
- Apple has no obligation to provide maintenance or support services.
- If the Service fails to conform to any applicable warranty, you may notify Apple and Apple will refund any purchase price for the app (if any); to the maximum extent permitted by law, Apple will have no other warranty obligation.
- Apple is not responsible for addressing claims relating to the Service, including product liability, legal compliance, or consumer protection claims.
- Apple is a third-party beneficiary of these Terms and may enforce them against you.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe it is necessary to protect the Service, users, or our rights.
